EXTENDED WARRANTY

Boston Business Technology, Inc. (“BBT”) warrants that, for any order or installation of NEW equipment, such equipment will be free from defects in workmanship and materials, when subject to normal use and maintenance conditions, for a period of ninety days from the date of installation at the buyer’s location. BBT warrants that ink and masters, when subject to normal use and storage conditions, will be free from defects for a period of twelve (12) months from the date of shipment from BBT to buyer.

BBT's obligation under this warranty is expressly limited to the repair or replacement (at BBT's election) of such covered BBT products that: (i) become defective within the specified warranty period, (ii) are brought to BBT's attention within thirty (30) days of occurrence of the defect, and (iii) are determined by BBT to be defective upon inspection, examination, or testing. BBT will provide warranty repairs to the equipment in accordance with general operating specifications and standards of the manufacturer. Unless otherwise requested by buyer, such repairs shall be performed during BBT’s regular business hours, and shall be at no additional charge to buyer, except as follows:

The BBT standard rate (i.e., the then current hourly rate charged by BBT for service technicians’ time and the BBT suggested retail prices for material) for those exceptions noted below will be charged for:

(1) service performed at buyer’s request on any BBT holiday or outside the business hours of 8:30AM and 5:00 PM (Eastern Time) Monday to Friday;

(2) all service other than service covered by this warranty;

(3) relocation service; and

(4) all supplies related to the repair, including masters, ink, and/or toner.

This warranty does not extend to any machine, or accessory, that has been subject to misuse, neglect (including but not limited to improper storage), or accident, nor does it extend to any machine, part, or accessory for which the problem subject to repair, service, or replacement was caused by a repair, alteration, or service performed by a party other than BBT, its authorized dealers, or BBT certified technicians. This warranty does not cover any damage or adjustments required to any BBT product if such damage or adjustment is caused by the use of improperly stored supplies or by supplies, parts, or attachments not sold or approved by BBT. All belts and all rubber components (e.g., transfer roller, transfer belt, cleaning roller, stripper pads), ink reservoir, pump filter, fuser kits, and all friction parts for paper feeding, are excluded from this warranty.

IN NO EVENT SHALL BBT BE LIABLE FOR SPECIAL, RESULTING, OR CONSEQUENTIAL DAMAGES, LOSS OF REVENUES OR PROFITS, OR PUNITIVE DAMAGES RESULTING, OR ALLEGED TO RESULT, FROM ANY BREACH OF WARRANTY OR USE OF THE EQUIPMENT BY BUYER. IN NO EVENT, SHALL BBT'S LIABILITY TO BUYER EXCEED THE LESSER OF BUYER’S PURCHASE PRICE, OR, IN THE ABSENCE OF A PURCHASE PRICE, THE FAIR MARKET VALUE (AS DETERMINED BY BBT) OF THE EQUIPMENT OR SUPPLY THAT IS DETERMINED BY BBT TO BE DEFECTIVE. THERE ARE NO OTHER WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION HEREIN STATED.

ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, REASONABLE CARE, AND/OR FITNESS FOR A PARTICULAR PURPOSE (WHETHER OR NOT BBT KNOWS, HAS REASON TO KNOW, HAS BEEN ADVISED, OR IS OTHERWISE IN FACT AWARE OF ANY SUCH PURPOSE), ARE EXCLUDED WITH RESPECT TO ANY BBT PRODUCT OR ANY OTHER PRODUCT SOLD, USED, OR PROVIDED UNDER THIS AGREEMENT. BBT FURTHER DISCLAIMS ANY AND ALL WARRANTIES, AND/OR REPRESENTATIONS OF TITLE AND NON-INFRINGEMENT WITH RESPECT TO ANY TRADEMARKS AND OTHER INTELLECTUAL PROPERTY, OR ANY LICENSED SOFTWARE AND/OR DOCUMENTATION.
